Terms & Conditions
This Serviced Accommodation Agreement, hereinafter referred to as “Agreement,” is entered into by yourself, hereinafter referred to as “Guest” and by Argyle Real Estate Ltd, Oakhill Cottage, Birmingham Road, Coventry, CV5 9AZ, hereinafter referred to as “Landlord.”
1. The Property: The property is described serviced accommodation and hereinafter referred to as the “Property.”
2. Period of Stay and Allowable Number of Guests: The total people in renting party consists of those stated in the booking, (e.g., number of adults, etc.), and shall not, under any circumstances, exceed this. The rental period starts on the time and date of check in and ends on the time and date of check out times, as provided by the Landlord.
3. Rental Amount: The total rental amount for the period is calculated at the standard room rate, plus any additional charges that may occur.
4. Rental Deposit and other fees: The Landlord reserves the right to retain the initial Rental Deposit after the said period prior to the rental start date. The amount is fully refundable up to 14 prior to the start date.
5. Termination of Agreement: Upon request, the Landlord may inspect the premises and make any necessary repairs with prior notice in accordance with applicable provincial laws. Suppose any of the terms of this agreement are violated by the Guest, in that case, the rental period shall be immediately terminated in accordance with applicable law if such violations occur.
6. When this agreement is terminated, the Guests waive all rights to process if they do not vacate the premises by the specified date and time. The Guests must vacate the premises at that time and date agreed upon.
7. Maintenance and Repairs of the Property: In addition, the Guests must keep the premises clean and ready for rent and use them legally and carefully. The Guests must pay for maintenance and repairs if they leave the premises in a lesser condition. If Guests damage the premises or furnishings, the Landlord will deduct the cost of said services from the security deposit before reimbursing the deposit. If the deposit does not cover the cost of said services, an additional fee must be paid by the Guest to Landlord to cover these costs. In this case, the Guest is also liable to pay an additional £100 fine.
8. House Rules: The Guest agrees to abide by the following House Rules at all times and shall ensure all rental Guests and anyone else who is allowed on the property abide by them:
a. A Guest must be at least 18 years of age, unless accompanied by an adult
b. Pets are not allowed
c. The check-in time is after 15:00, and the check-out time is by 10:00
d. Check-in using a lockbox
e. It is prohibited to smoke (marijuana or tobacco cigarettes, cigars, electronic cigarettes, or any similar product generating smoke or vapor), attend parties, or participate in events involving smoking
f. Between 22:00 and 08:00, please be respectful of the neighbours and reduce the volume of your noise
g. Strictly no parties or gatherings allowed
All Guests are subject to a £100 fine in the event that these rules are broken. Please note that fines for parties are £250, and must be paid by the Guest.
9. Fair Usage Policy. The following fair usage policy will apply to your gas, electricity and water consumption. This is to ensure that your energy usage is not excessive and stays within reasonable allowances. If the limits are exceeded, your Landlord reserves the right to apply a supplemental charge to cover the amount by which you exceeded the allowances, plus an additional £75 penalty charge. The allowances are designed to be generous and if you are sensible with your energy consumption, it is unlikely you will exceed these limits. 10. Subletting: No right of subletting shall be granted to the Guest.
11. Respect Quiet Enjoyment: Guests are expected to behave civilly and respect the rights of surrounding property owners while remaining respectful of them. They shall refrain from creating noise or disturbances likely to disturb or irritate the surrounding property owners.
As a consequence of creating a disturbance of this nature, this agreement will be immediately terminated, and Guests will have to vacate the premises immediately.
12. Landlord’s Liability: The Landlord’s liability for personal injury or property damage arising from the use of premises is indemnified and held harmless by Guests and those who accompany said Guest, regardless of the nature of the injury or damage. The Guests explicitly acknowledge that any insurance the Landlord maintains does not cover their personal property, so they should purchase their own insurance.
13. Attorney’s Fees: To enforce this agreement, the Landlord will incur all reasonable costs, attorney’s fees, and expenses incurred by Guests.
14. Use of Property: It is expressly acknowledged and agreed that Guests do not intend to use the Property as a residence or household or for commercial purposes during the term of this Agreement. Neither the Guest nor any other party may use the property for illegal activities.
This agreement will terminate without a refund of rent and deposits. Marijuana, Cannabis, or similar plants may not be grown on the premises by the Guest.
15. Governing Law: This contract is governed by the laws of the UK where it was entered.
16. Other Agreements: In addition, to the language stated in this agreement, the parties, Landlord and Guest, agree to the following:
a. Any monies payable in this agreement shall be paid by Guest within two (2) working days of a written notice sent by the Landlord demanding the same.
b. Unless otherwise specified, a reference to a law is a reference to it as it is in force for the time being taking account of any amendment, extension, application or re-enactment and includes any subordinate legislation for the time being in force made under it.
c. A person includes a corporate or unincorporated body.
d. Writing or written includes faxes but not e-mail.
e. Any obligation in this Agreement on a person not to do something includes an obligation not to agree or allow that thing to be done.
f. Any reference to the Landlord or Guest includes their respective personal representatives and successors in title.
g. Words importing one gender shall be construed as importing any other gender.
h. Words importing the singular shall be construed as importing the plural and vice versa.
i. Where any party comprises more than one person the obligations and liabilities of that party under this agreement shall be the joint and several obligations and liabilities of those persons.
Landlord and Guest agree to the above conditions on this day and hereby swear that the information provided is accurate and true.
